  Use Policy

During the period of time as listed in this agreement, the subscriber ("User") agrees to abide by the rules and conditions set forth in this contract which defines EE-Link Internet Services ("Provider") duties as the User's Internet Service Provider ("ISP").

Our Responsibilities

  1. During the period of time listed in this agreement, the Provider will make available to the User a preset ID along with a "personal directory" for temporary storage. This "personal directory" is for temporary storage ONLY, and the User is solely responsible in maintaining the files found therein. Upon expiration of this contract, the Provider and User can extend the period of time by mutual agreement at current rates.
  2. The Provider will maintain 24 hour access to the service expand capacities to meet demand when required.
  3. The Provider will not be responsible for failures with the User's equipment or software. The Provider's liability ends with providing the User Internet Hosting and email services. Hardware/software conflicts in the User's equipment or software are solely the User's responsibility.

Your Responsibilities:

  1. The User shall be responsible for all accesses to their system account and maintenance of the passwords used on the Provider's system. Likewise the User will be responsible for all charges on their system account. The User agrees not to share or otherwise make their account available to others. The Provider reserves the right to suspend a Users account when violations are discovered.
  2. The User agrees to abide by US Federal Law and International Treaties in regards to copyrighted materials, and to not upload or otherwise make available such material without the express permission of the copyright owner. This refers to all copyrighted Shareware, Freeware, Commercial and/or Non-commercial data, software, and information. The User is responsible for all information/data originating from or destined to the User's account.
  3. The User agrees not use the ISP in any method or activity which is prohibited by law. Users found in violation will have their account closed immediately upon discovery of such activities and will be barred from any future access of the Provider's system. The Provider will assist any law enforcement agency with investigations when enforcement officials provide warrants or writs regarding illegal activity by any User. The User agrees not to use any process or program to determine another member's password, and also agrees not to use their ISP account to circumvent the security of any other system or network.
  4. The User agrees to indemnify and hold the Provider harmless from any claims, including attorney's fees, resulting from the User receiving or not receiving Provider's services which cause direct or indirect damage to the User or another party. The User further acknowledges that the Provider has no input or control over information/data available on any other interconnected system. The Provider makes no warranty of any kind, either expressed or implied, regarding the accuracy or validity of any information/data from any of the resources available on the Internet. Use of said information/data is solely the risk and responsibility of the User.

Abuse of Services:

Any use or misuse of the ISP that disrupts the ability of other Users to normally access the Provider's services is to be considered an abuse of system resources and will be grounds for administrative intervention. Dependent on the nature and severity of ISP abuse, the User may receive an warning via e-mail, or for repeated abuses the User's account may be suspended. The Provider reserves the right to discuss the abuse, unintentional or not, with the User before service is restored. Ethical or legal violations of the rules and policies of the ISP will be investigated to the fullest extent possible, but User access may be denied during such an investigation when system security is at risk. You agree that the ISP may be used only for lawful purposes. Accordingly, you shall not post or transmit through the ISP any unlawful, harmful, threatening, abusive, harassing, vulgar, offensive, obscene, defamatory, profane, hateful, or racially, ethnically or otherwise objectionable or distasteful material of any kind nor any material which encourages conduct which would constitute a criminal offense or give rise to civil liability or otherwise violate any applicable local, state, federal or international law. You further agree not to attempt to configure your computer so as to permit any other computer to connect to your computer via Telnet, ftp or otherwise. You agree that any attempt to violate any of these restrictions will result in the immediate termination of your account. Any user participating in e-mail or Usenet "spamming" will receive ONE warning upon receipt of the first complaint. After the first initial warning, your account will be immediately terminated upon discovery of additional acts of abuse and will not be reactivated under any circumstance.

No Warranty:

While the Provider believes that the ISP services and information contained in this document are accurate and correct, the Provider makes no warranty as to the suitability, accuracy, or correctness of any system service or the information/data contained therein. No refunds will be given under any circumstance.

Limitation of Liability:

In no event shall the Provider or ISP be liable for any direct, indirect, consequential damages, or lost profits due to, or arising from this agreement, or the performance, or lack thereof, of any system service. ISP' liability is limited to provision of service, excepting events or instances beyond our control such as acts of God, acts by any government, war or other outbreak of hostility, civil disorder, fire, power or equipment failure, labor dispute, and inability to obtain necessary supplies and spare parts. No claims which in any way arises out of this Agreement or the inability to use the ISP may be made by any party hereto more than one year after the basis for the claim becomes known to the party desiring to assert it. No refunds for service, used or unused, will be given under any circumstances.
